Terms of use

These terms apply when you use Marcus, the test-marking web app at getmarcus.co. T Freeman operates Marcus from Victoria, Australia ("we", "us"). By creating an account or using Marcus, you agree to these terms and to our Privacy policy. If you do not agree, please do not use Marcus.

1. Who can use Marcus

Marcus is for teachers and other school staff aged 18 or over. You need an account, and Marcus administrators approve each one. We may decline a request for an account.

2. Your account

• Give accurate details, and keep them up to date in My Profile.
• Keep your password private and do not share your account. You are responsible for what happens under your account.
• Tell us at admin@getmarcus.co if you think someone else has used it.

3. Cost and limits

Marcus is free to use. Each account has monthly limits, which Marcus administrators set: the number of students marked, the number of students whose names the AI reads (100 by default), and a cap on AI spending.

4. Using Marcus fairly

You agree to use Marcus only for marking tests and related school work, and to follow the law and your school's policies. You must not:

• upload papers or information you do not have the right to use;
• try to break, overload, probe or get around the security or limits of Marcus;
• copy, resell or build a competing service from Marcus, or use automated tools to access it, except as Marcus itself provides;
• use Marcus to harass anyone, or to store or send anything unlawful.

5. Student information

You and your school decide how students' information is used, and you are responsible for having the permissions your school and the law require. Marcus keeps scans, answers and scores on your computer.

Marcus uses AI only for three jobs, and only when you choose to: reading students' handwritten names, reading an answer key from a photo or PDF, and finding the answer options on a question paper. Each sends information to Anthropic, an AI service based in the United States that may process it overseas, exactly as section 5 of our Privacy policy describes. When you use them:

• use AI features only if your school allows it, and choose "Don't use AI" for names whenever you prefer not to share them;
• upload only pictures you are allowed to share, and crop out any student's name or work from a photo of an answer key, because Marcus sends the whole picture;
• do not use AI features to send information Marcus does not ask for.

When you download, copy or share results, they go straight from your device to the place you choose, not through Marcus. You are responsible for where you send them: share students' results only in ways your school allows.

6. Check the results

Marcus is a tool to help you mark. It reads each answer for you and asks you about any it is unsure of, but it can still make mistakes, for example with faint marks, unusual sheets or photos. Names, answer keys and layouts read by AI can be wrong too, so check them on screen. You are responsible for checking the results before you rely on them or share them, and the marks you give remain your professional judgement.

7. Your content

Your tests, answer keys, class lists and results belong to you or your school. We do not claim any ownership of them. You allow us to handle the limited information described in our Privacy policy, only so we can provide Marcus to you.

8. Our content

The Marcus software, name, logo and help guide belong to us. While you have an account, we give you a personal, non-transferable right to use Marcus under these terms.

9. Availability and your data

We work to keep Marcus running well, but we cannot promise it will always be available, error-free or unchanged. We may update, suspend or stop parts of Marcus, and we will try to give you notice of major changes. Your archive is stored in your browser, so clearing your browser's data or changing computers can remove it: download the files you need to keep.

10. Our responsibility to you

Nothing in these terms limits your rights under the Australian Consumer Law or any other law that cannot be excluded. Apart from those rights, and to the extent the law allows:

• Marcus is provided as it is, without other promises about its results;
• we are not responsible for indirect loss, such as lost data, lost time or lost opportunities, or for loss caused by mistakes you did not check;
• where the law lets us limit our liability, it is limited to supplying Marcus to you again, or paying the cost of having it supplied again.

11. Ending your use

You can stop using Marcus and delete your account at any time in My Profile. We may suspend or close an account that breaks these terms, puts Marcus or other users at risk, or that we must close by law. Where it is reasonable, we will tell you first.

12. Changes to these terms

We may update these terms as Marcus changes. We will update the date at the top, and if a change is significant, we will tell you by email or in Marcus before it takes effect. If you keep using Marcus after a change takes effect, the new terms apply.

13. Law and disputes

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria can hear any dispute about them. If you have a concern, please contact us first at admin@getmarcus.co so we can try to sort it out.
